Quick At – Driver Partner Agreement

This Driver Partner Agreement ("Agreement") applies to every driver who applies to register, is registered, or provides e-hailing, transport, delivery, panic response support, or related mobility services through the Quick At platform ("Platform"). By applying as a driver, activating a driver account, accepting trips, or using the driver features of the Platform, you agree to be bound by this Agreement.
1. Platform Relationship
1.1 Quick At is a technology platform that connects independent drivers with passengers and users.
1.2 Quick At does not employ drivers unless expressly stated in a separate written agreement.
1.3 You act as an independent contractor and not as an employee, agent, joint venture partner, or representative of Quick At.
1.4 Nothing in this Agreement creates an employment relationship, partnership, franchise, or agency relationship between you and Quick At.
2. Driver Eligibility
To register and remain active as a driver, you must at all times:
2.1 be at least 18 years old, or older if required by law;
2.2 hold a valid South African driver's licence for the class of vehicle used;
2.3 provide valid identity and contact details;
2.4 provide all documents requested by Quick At, including your driver's licence, ID or passport, proof of address, vehicle documents, profile image, banking details, operating permits where required, and any additional compliance documents;
2.5 be legally entitled to provide transport services in the areas where you operate; and
2.6 comply with all applicable laws, traffic rules, permit requirements, and municipal, provincial, and national transport regulations.
3. Driver Account and Verification
3.1 You must provide true, complete, and current information at all times.
3.2 Quick At may request identity verification, document verification, facial verification, background screening, or additional compliance checks at any time.
3.3 Quick At may refuse, suspend, restrict, or terminate a driver account where information cannot be verified or where Quick At considers there to be a safety, fraud, legal, or reputational risk.
3.4 You are responsible for all activity conducted through your driver account and must keep your login details secure.
4. Vehicle Requirements
4.1 Every vehicle used on the Platform must be roadworthy, safe, clean, and legally licensed for road use.
4.2 You must ensure that the vehicle has valid licence documentation, registration, and any permits required by law.
4.3 You must ensure that the vehicle is maintained in proper working condition, including brakes, tyres, lights, mirrors, seatbelts, wipers, and all safety equipment.
4.4 Quick At may require vehicle inspections, photographs, maintenance evidence, or proof of compliance.
4.5 Quick At may deactivate any vehicle that is unsafe, unfit, damaged, misleadingly listed, or non-compliant.
5. Driver Responsibilities
You agree to:
5.1 provide transport services professionally, lawfully, and safely;
5.2 treat passengers and users with dignity and respect;
5.3 arrive at pickup points as promptly as reasonably possible;
5.4 follow the route chosen by the passenger where lawful and safe, or a reasonable route where none is specified;
5.5 ensure passengers are transported in a vehicle that is clean and reasonably comfortable;
5.6 obey all road traffic laws and transport rules;
5.7 never drive while intoxicated, under the influence of drugs, fatigued to the point of unsafe driving, or otherwise unfit to drive;
5.8 never permit an unauthorised person to use your driver account or provide trips under your account; and
5.9 promptly report safety incidents, accidents, complaints, criminal conduct, or emergency events related to Platform activity.
6. Passenger Safety and Conduct
6.1 You must make reasonable efforts to verify that the correct passenger enters the vehicle.
6.2 You must not discriminate unlawfully against passengers on the basis of race, gender, religion, disability, nationality, sexual orientation, or any other protected ground.
6.3 You must not harass, threaten, intimidate, exploit, assault, or behave abusively toward any passenger or user.
6.4 You must comply with Quick At safety policies, panic procedures, and incident reporting processes.
7. Prohibited Conduct
You may not:
7.1 use the Platform for fraud, criminal conduct, or unlawful transport activity;
7.2 transport illegal goods or substances;
7.3 carry weapons unlawfully;
7.4 falsify trips, manipulate the app, create fake accounts, or attempt to exploit pricing, incentives, or support processes;
7.5 share, sell, rent, or transfer your account to another person;
7.6 bypass Platform payment systems where a booking originated through Quick At;
7.7 solicit passengers in a way that breaches law or Platform rules; or
7.8 engage in any conduct that may endanger users, Quick At, or the public.
8. Driver Status and Flexibility
8.1 You are free to choose when to log in to the Platform, subject to any availability, quality, or compliance standards imposed by Quick At.
8.2 Quick At may set service standards, onboarding requirements, document requirements, app rules, and safety policies.
8.3 Quick At may offer promotions, incentives, quality programs, ratings systems, and performance measures, but these do not create employment.
9. Fares, Payments, and Wallet
9.1 Quick At may calculate or facilitate the calculation of fares, service fees, cancellation fees, and other applicable charges.
9.2 Quick At may collect payments from passengers and remit the relevant portion to you after deducting commissions, service fees, payment processing fees, chargebacks, refunds, adjustments, or other lawful deductions.
9.3 Payments may be made through the Quick At wallet or another payment channel designated by Quick At.
9.4 Quick At may delay, hold, reverse, or set off payments where fraud, disputes, refunds, chargebacks, policy violations, or legal compliance concerns arise.
9.5 You are responsible for ensuring that your banking and payout details are accurate and current.
10. Driver Fees and Charges
10.1 Quick At may charge driver commissions, subscription fees, onboarding fees, service fees, technology fees, payment processing fees, and other fees disclosed on the Platform.
10.2 Quick At may update its fee structure from time to time by notice in the app, on the website, or through other reasonable communication.
11. Taxes and Legal Compliance
11.1 You are solely responsible for your own taxes, levies, returns, social contributions, VAT obligations where applicable, permits, and legal reporting obligations arising from your activities on the Platform.
11.2 Quick At does not provide tax advice and does not accept responsibility for your tax compliance.
12. Ratings, Complaints, and Quality Standards
12.1 Quick At may allow passengers to rate drivers and submit complaints.
12.2 Quick At may investigate complaints, review account behaviour, and apply quality or safety standards.
12.3 Low ratings, repeated complaints, unsafe conduct, or repeated service failures may result in warnings, temporary suspension, retraining requirements, or permanent deactivation.
13. Accidents, Incidents, and Emergency Events
13.1 You must report any accident, injury, criminal event, vehicle breakdown, road incident, panic event, police matter, or other serious safety incident connected to Platform use as soon as reasonably possible.
13.2 You must cooperate with Quick At in any incident review and provide truthful information, photos, reports, and supporting evidence.
13.3 Quick At may suspend your account during the review of a serious incident.
14. Insurance
14.1 You are solely responsible for maintaining all insurance required by law and any additional cover appropriate for public transport, e-hailing, commercial use, passenger liability, own-damage, theft, or third-party risk.
14.2 Unless expressly stated in writing, Quick At does not provide insurance for you, your vehicle, your passengers, or your property.
14.3 You acknowledge that personal-use motor insurance may not cover e-hailing or commercial transport activity.
15. Limitation of Quick At Responsibility
15.1 Quick At acts solely as a technology intermediary platform.
15.2 Quick At does not guarantee trip volumes, earnings, passenger behaviour, route conditions, emergency outcomes, or the conduct of any third party.
15.3 To the maximum extent permitted by law, Quick At is not liable for driver losses, loss of income, vehicle damage, theft, passenger misconduct, assaults by third parties, downtime, data loss, indirect losses, or consequential damages arising from use of the Platform.
16. Driver Liability and Indemnity
16.1 You are responsible for your driving, your vehicle, your compliance, and your conduct toward passengers and the public.
16.2 You agree to indemnify and hold harmless Quick At, its officers, employees, affiliates, contractors, and agents against claims, damages, liabilities, fines, losses, and expenses arising from your conduct, your vehicle, your trips, your breach of this Agreement, or your breach of law.
17. Suspension and Termination
17.1 Quick At may suspend, restrict, or terminate your account immediately where necessary for safety, fraud prevention, legal compliance, or Platform integrity.
17.2 Grounds for suspension or termination may include document expiry, false information, dangerous driving, criminal conduct, misuse of the app, passenger abuse, repeated complaints, low ratings, permit failures, or any other material breach of this Agreement.
17.3 You may stop using the Platform at any time, subject to the resolution of any outstanding disputes, claims, payment adjustments, or legal obligations.
18. Data Protection and Privacy
18.1 Quick At may collect and process your personal data in accordance with its Privacy Policy and applicable South African law.
18.2 You consent to the processing of your data for onboarding, verification, payments, safety, compliance, support, fraud prevention, and Platform operations.
19. Changes to this Agreement
19.1 Quick At may amend this Agreement from time to time.
19.2 Updated versions may be published on the Platform, and your continued use of the Platform after the effective date of the updated version constitutes acceptance of the revised Agreement.
20. Governing Law
20.1 This Agreement is governed by the laws of the Republic of South Africa.
20.2 Any dispute arising from or connected to this Agreement shall be subject to the jurisdiction of the competent courts of South Africa, unless applicable law requires otherwise.

Driver Acknowledgement
By applying to become a driver, activating a driver account, or accepting trips through Quick At, you acknowledge and agree that:
• you have read and understood this Driver Partner Agreement;
• you are an independent contractor and not an employee of Quick At;
• you are responsible for your vehicle, insurance, permits, taxes, and legal compliance;
• you accept responsibility for the safe and lawful operation of your vehicle; and
• you agree to the Quick At Terms and Conditions, Privacy Policy, Community Safety Guidelines, and any other policies applicable to your use of the Platform.
