Quick At – Terms and Conditions

These Terms and Conditions govern access to and use of the Quick At platform, including e-hailing, vehicle rental, wallet, panic and related services. By registering, booking, uploading a vehicle, applying as a driver, funding a wallet, or using any Quick At service, you agree to these terms.
1. Definitions
In these Terms:
- “Quick At” means the Quick At platform, website, mobile application, operators, administrators and payment workflows.
- “User” means any person who accesses or uses the platform.
- “Passenger” means a user requesting an e-hailing ride.
- “Driver” means an independent person offering transport services through the platform.
- “Owner” means a person listing a vehicle for rental.
- “Renter” means a person renting a listed vehicle.
- “Wallet” means the internal stored-value balance or credit functionality available on the platform.
- “Panic Service” means emergency, safety-alert, SOS, guardian, or location-sharing functionality.
2. Platform Role
Quick At is a technology platform that connects independent users. Quick At does not itself provide transport services, does not employ drivers unless expressly stated in writing, does not own listed vehicles unless expressly stated in writing, and does not guarantee the conduct, quality, legality, suitability, timing, roadworthiness, or availability of any user, ride, or vehicle.
3. Eligibility
To use Quick At you must be at least 18 years old, have legal capacity to enter into binding agreements, provide accurate registration details, and comply with all applicable South African laws and regulations.
4. Account Registration
You must provide accurate, current and complete information. You are responsible for all activity under your account, for safeguarding your password, and for ensuring that your mobile number, email address, identity information, license details, and payment information remain correct and up to date.
5. Acceptance of Policies
By creating an account or using a service, you also agree to the policies and agreements linked on the platform, including the Privacy Policy, Driver Partner Agreement, Vehicle Owner Rental Agreement, Vehicle Owner Terms and Conditions, Community Safety Guidelines, Refund and Cancellation Policy, Wallet terms displayed at checkout or top-up, and Panic Service notices displayed during activation.
6. E-Hailing Services
Passengers may request rides through the platform. Drivers may accept or reject requests. Once a booking is accepted, the transport service is arranged between the passenger and the independent driver. Estimated fares, ETAs and routing are illustrative only and may change due to traffic, distance, waiting time, tolls, demand conditions, or service fees.
7. Vehicle Rental Services
Quick At may enable owners to list vehicles and renters to book them. Rental transactions are entered into between the owner and the renter. Quick At is not responsible for the listed vehicle, mechanical condition, handover quality, hidden defects, title, legality, damage claims, or disputes between owners and renters.
8. Driver Status
Drivers are independent contractors unless Quick At expressly signs a separate employment agreement. Drivers are solely responsible for licensing, permits, vehicle compliance, tax, insurance, route compliance, road law compliance, passenger conduct management, and lawful operation of their vehicles.
9. Owner Status
Owners listing vehicles confirm that they are the lawful owners or are fully authorized to rent the vehicles, that the vehicles are roadworthy and legally registered, and that they maintain all legally required insurance, inspections and maintenance.
10. User Conduct
Users may not use the platform for unlawful conduct, fraud, abuse, harassment, discrimination, unauthorized account access, fake bookings, chargeback abuse, transport of illegal goods, dangerous conduct, violence, threats, or attempts to bypass platform fees or controls.
11. Payments and Wallet
Quick At may process fares, rental amounts, deposits, fees, refunds, credits and commissions through external gateways or the Quick At Wallet. Wallet balances are not bank deposits, do not earn interest, may be subject to verification and hold periods, and may be restricted where fraud, disputes, chargebacks, or compliance issues are suspected.
12. Fees and Deductions
Quick At may charge service fees, booking fees, ride commissions, rental commissions, cancellation charges, processing fees, wallet fees, promotional adjustments, and administrative fees. Quick At may set off or deduct such amounts from funds otherwise payable to a user where permitted by law and platform rules.
13. Cancellations and Refunds
Cancellation fees and refund outcomes depend on the service, the timing of cancellation, the conduct of the parties, payment gateway rules, safety events, and the Refund and Cancellation Policy. Some fees may be non-refundable, including processing or administrative charges where clearly disclosed.
14. Panic and Safety Services
The panic service is provided to assist with alerts and emergency escalation. Quick At does not guarantee emergency response times, emergency service attendance, successful intervention, uninterrupted tracking, mobile signal coverage, or device functionality. Misuse of the panic feature may result in suspension or termination.
15. Privacy
Quick At processes personal information in line with its Privacy Policy and applicable South African law, including POPIA. By using the platform, you consent to the collection, use, storage, sharing and processing of personal information as reasonably necessary for identity verification, service delivery, fraud prevention, payment handling, customer support, safety, platform improvement and legal compliance.
16. Verification and Monitoring
Quick At may verify identity, driver’s licenses, vehicle documents, profile information, device information, usage history, trip details, account activity and other data reasonably required to protect the platform and its users. Quick At may refuse, pause or remove services where verification is incomplete or concerns arise.
17. Suspension and Termination
Quick At may suspend, limit or terminate any account, listing, driver profile, wallet function or booking access at any time where there is suspected fraud, safety risk, abuse, policy breach, non-payment, unlawful conduct, repeated complaints, document expiry, or platform misuse.
18. No Warranty
The platform is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, Quick At makes no warranties regarding uninterrupted availability, fitness for a particular purpose, driver availability, passenger conduct, vehicle quality, journey outcomes, listing accuracy, payment timing, earnings level, or user behaviour.
19. Limitation of Liability
To the fullest extent permitted by law, Quick At will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profit, loss of business, loss of use, reputational harm, data loss, personal property loss, trip interruption, vehicle downtime, or lost opportunity. Quick At is also not liable for acts or omissions of passengers, drivers, owners, renters, payment providers, emergency services, mobile networks, insurers, or third parties.
20. Vehicle Damage and Driver Conduct
Quick At does not accept responsibility for any damage to a vehicle listed or used on the platform, including damage caused by a renter, driver, passenger, third party, accident, misuse, theft, vandalism, weather event, mechanical failure, road hazard, fine, impoundment or unlawful conduct. Claims relating to vehicle damage, loss, fines or misuse must be addressed between the owner, renter, driver, insurer, or other responsible party.
21. Indemnity
You agree to indemnify and hold harmless Quick At, its affiliates, officers, employees, contractors and agents from claims, losses, liabilities, penalties, damages and reasonable legal costs arising from your use of the platform, your breach of these Terms, your violation of law, your content, your listings, your driving, your rented vehicle use, or your dealings with any other user.
22. Intellectual Property
The Quick At name, logos, interface, designs, text, systems, software and platform materials remain the property of Quick At or its licensors. You may not copy, reverse engineer, scrape, republish, reproduce or exploit the platform except as allowed by law or with written permission.
23. Complaints and Support
Users may submit complaints, support requests, safety reports or refund requests using the platform contact channels. Quick At may investigate and request documents, screenshots, call records, receipts, photos, videos, trip details or other supporting evidence.
24. Changes to Terms
Quick At may amend these Terms at any time by posting an updated version on the website or application. Continued use of the platform after the effective date of the updated version constitutes acceptance of the revised Terms.
25. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or related to these Terms or the platform will be subject to the jurisdiction of the courts of South Africa, unless applicable law requires otherwise.

By continuing to use Quick At, you confirm that you have read and understood these Terms and Conditions, that you accept them, and that you understand Quick At acts as a technology platform and not as the direct provider of independent ride, rental, or vehicle-owner services unless expressly stated otherwise in writing.
